This Privacy Policy explains how Kaya Technologies LLC (“Kaya”, “we”, “us”), which operates the Kaya Haiti marketplace and delivery platform (the “Service”), collects, uses, shares, and protects your information when you use our websites and mobile applications. By using the Service you agree to the practices described here.
1. Who we are
Kaya Haiti is a brand operated by Kaya Technologies LLC. Kaya Haiti connects customers with local stores, restaurants, sellers, and delivery drivers across Haiti. If you have any question about this policy, contact us at kayahaiti.contact@gmail.com.
2. Information we collect
- Account information — your name, phone number, and email address when you create an account or sign in. Phone number is used as the primary sign-in method (one-time code).
- Profile & identity verification — for sellers and delivery drivers we collect identity documents (national ID, passport, or driver’s licence), a live selfie, and a profile photo to confirm identity, prevent fraud, and keep the community safe. Business details (store name, category, address) are collected for sellers.
- Orders & transactions — items you view, add to cart, and purchase; order history; and delivery status.
- Delivery addresses & location — addresses and, if you allow it, your device location to set a pickup or delivery point and match you with nearby stores and drivers.
- Communications — messages you send to sellers, drivers, or support, and notifications we send you (including by WhatsApp, SMS, email, or in-app), such as order confirmations and delivery updates.
- Device & usage data — app version, device type, and basic usage information used to operate and improve the Service.
3. How we use your information
- Provide, operate, and maintain the Service and your account.
- Process and deliver your orders and enable pickup and delivery.
- Verify the identity of sellers and drivers, prevent fraud, and protect users.
- Send you service messages — order confirmations, delivery updates, security codes, and support replies.
- Provide customer support and respond to your requests.
- Improve and secure the Service and comply with legal obligations.
4. WhatsApp and messaging
We may use the WhatsApp Business Platform (provided by Meta Platforms, Inc.), as well as SMS, email, and in-app notifications, to send you order and service-related messages and to answer support requests. When you contact us or opt in, your phone number and the content of those messages are processed to deliver the conversation. Messages sent through WhatsApp are also subject to WhatsApp’s and Meta’s own terms and privacy policy. You can stop receiving non-essential messages at any time by replying STOP or by contacting us; essential messages (such as security codes and order status) may still be sent while you have an active account or order.
5. How we share information
We do not sell your personal information. We share it only as needed to run the Service:
- Sellers and drivers — to fulfil your order (for example a driver sees the delivery name, address, and the seller’s pickup details).
- Service providers — hosting, database, identity-verification, and payment partners that process data on our behalf under appropriate safeguards.
- Legal and safety — when required by law, or to protect the rights, property, and safety of Kaya, our users, or the public.
- Business transfers — in connection with a merger, acquisition, or sale of assets, subject to this policy.
6. Payments
Payments are processed by third-party payment providers. We do not store full card numbers on our systems. Information you provide to a payment provider is handled under that provider’s own privacy policy.
7. Data retention
We keep your information for as long as your account is active or as needed to provide the Service, comply with legal obligations, resolve disputes, and enforce our agreements. Identity-verification documents are retained only as long as needed for verification, safety, and legal purposes, and are then deleted or de-identified.
8. Security
We use administrative, technical, and organisational measures designed to protect your information. No method of transmission or storage is completely secure, but we work to protect your data and to limit access to those who need it to operate the Service.
9. Your rights and choices
- Access, correct, or update your account information from within the app or website.
- Request deletion of your account and associated personal data.
- Opt out of non-essential messages.
- Control device permissions such as location and camera through your device settings.

10. Children
The Service is intended for users who are 18 years of age or older. We do not knowingly collect personal information from children. If you believe a child has provided us information, contact us and we will delete it.
11. International users
Kaya Haiti serves customers and partners in Haiti and the diaspora. Your information may be processed and stored in countries other than your own, where our service providers operate, with appropriate safeguards.
12. Changes to this policy
We may update this Privacy Policy from time to time. When we do, we will revise the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect means you accept the updated policy.
