Welcome to Kaya Haiti. By creating an account or using the Kaya app or website (the “Service”), you agree to these Terms of Use. Please read them carefully.
Kaya Haiti (“Kaya”, “we”) is a marketplace and delivery platform that connects buyers, sellers, restaurants, hotels and drivers in Haiti and the diaspora. Kaya facilitates these connections; sellers, restaurants, hotels and drivers are independent and responsible for what they offer.
You are responsible for the accuracy of your information and for keeping your phone and login codes secure. An account is personal. Sellers and drivers must be at least 18 years old. You may sign in with your phone number, or with Facebook or Google — used only to authenticate you and personalize your experience.
Prices are shown in gourdes (HTG) or in dollars depending on your region. Placing an order means you accept the price, delivery fees and taxes displayed. Mobile payments (MonCash, NatCash) and card payments are processed by the relevant providers; Kaya does not store full card numbers.
Delivery times are estimates and may vary with driver availability, distance and traffic. Kaya is not responsible for delays beyond its reasonable control.
Sellers, restaurants, hotels and drivers are responsible for the compliance, quality and legality of their products and services. Kaya may suspend or remove a partner that does not respect these Terms or the law.
You agree not to use Kaya for fraud, illegal goods or services, or any abuse of the platform. Kaya may suspend or close an account that violates these Terms.
Reviews and content you submit must be honest and lawful. You grant Kaya a non-exclusive license to display the content you submit within the Service.
The Kaya name, logo, app and website are protected and may not be used without our permission.
If you have a problem with an order, please contact Kaya support before making any claim, at support@kayahaiti.com.
The Service is provided “as is”. To the extent permitted by law, Kaya is not liable for indirect damages, and our liability is limited to the amount of the transaction concerned.
Your use of Kaya is also governed by our Privacy Policy. You can delete your account and data at any time — see our Data Deletion page.
We may update these Terms; the version in force is the one published here. These Terms are governed by the laws of the Republic of Haiti.
En utilisant Kaya Haiti, vous acceptez ces conditions. Kaya est une place de marché et une plateforme de livraison qui met en relation acheteurs, vendeurs, restaurants, hôtels et chauffeurs. Les prix sont affichés en gourdes ou en dollars ; une commande vaut acceptation du prix, des frais et des taxes affichés. Les délais de livraison sont des estimations. Les vendeurs sont responsables de leurs produits. Sont interdits la fraude et les produits illégaux. Votre utilisation est aussi régie par notre politique de confidentialité, et vous pouvez supprimer votre compte à tout moment (voir la page de suppression des données).
